Family-Based Immigration in the U.S.

Family-based immigration is a way for U.S. citizens and green card holders (lawful permanent residents) to help their family members live in the United States permanently.

It’s one of the most common ways people get green cards and is designed to keep families together.

Types of Family-Based Immigration

There are two main groups under family-based immigration:

  • Immediate Relatives: These are close family members of U.S. citizens, including:
    • Spouses
    • Children under 21 who are not married
    • Parents (if the U.S. citizen is at least 21 years old)

    There’s no limit on the number of green cards available for immediate relatives, so this process is usually faster.

  • Family Preference Categories: These include relatives of U.S. citizens and green card holders who don’t qualify as immediate relatives. There are yearly limits on the number of visas available, so the wait can be long. The categories include:
    • F1: Unmarried children (21 or older) of U.S. citizens
    • F2: Spouses and children of green card holders
    • F3: Married children of U.S. citizens
    • F4: Brothers and sisters of U.S. citizens (if the citizen is at least 21 years old)

How the Process Works

The process involves two main steps:

  1. Filing the Petition: The U.S. citizen or green card holder (the sponsor) files Form I-130 to prove their family relationship with the person applying for a green card (the beneficiary).
  2. Green Card Application:
    • If the family member is in the U.S., they may apply for a green card through adjustment of status.
    • If they are outside the U.S., they will apply through consular processing at a U.S. embassy or consulate.
